Knitcraft, Inc., a Missouri corporation, warrants to the original purchaser of this Silver Reed Knitting Machine that this machine will be free of defects in materials and workmanship for a period of three (3) months from the original date of purchase. This warranty applies only if the machine is used for non-industrial purposes. If the machine should become defective within the specified warranty period. Knitcraft will replace any part(s) that appear, to its satisfaction, to have been defective in material or workmanship. Purchaser shall bear any transportation, removal, or installation charges in connection with the inspection, repair, or replacement of defective parts. The limited warranty obtained herein is the purchaser's exclusive remedy. To obtain warranty service, the purchaser must deliver the machine or the defective part(s) to Knitcraft, Inc., 500 N. Dodgion, Independence, MO 64050. Shipping expenses are the purchaser's responsibility. A copy of the original sales receipt verifying proof of purchase must be submitted with the machine. This warranty does not cover any defects or costs caused by: (1) modification, alteration, repair, or service of this machine by anyone other than the manufacturer; (2) physical abuse to, or misuse of, the machine or operation thereof in a manner contrary to the accompanying instructions; (3) any use of the machine other than that for which it was intended; (4) shipment of the machine to Knitcraft, Inc. for service. This warranty and any disputes or claims arising out of or in connection with its subject matter are governed by and construed in accordance with the State of Missouri. The parties irrevocably agree that the courts of Missouri have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Warranty, and venue for any such action shall be in the Circuit Court of Jackson County, Missouri. Knitcraft, Inc. will not be liable for any damages, losses, or expenses as a result of purchaser's negligence, whether deemed active or passive, and whether or not any such negligence is the sole cause of any such damage, loss, or expense.
